Anyone who has tried to maintain the dynamic nature of the legend item in ArcMap while re-scaling, opening and closing, panning, adding new data, etc. knows what I'm talking about. Stupid thing likes to re-scale at the drop of a hat with no control. This includes font sizes, patch sizes, and spaces between items. Why this was considered a good idea, well, ya got me.

I've asked, posted it in ideas, and I think something might be coming out in 10.1, but in the interim if anyone has a solution, would love to hear it.

One tip would be to not create the legend until your done with the layout. When you're ready, create the legend, convert it to a graphic, then tweak it as needed. – Michael Todd Aug 17 '11 at 3:04

I would repeat what Michael said above, but admittedly, I sometimes find these quirks a tad annoying too. You may also want to look at this post for legend limiter. It wouldn't resolve all the issues you've mentioned, but it's a nice little add-on to save time & effort. Do a read-up.
