Is there any legal way to search and download google maps POI , based on user location and search radius (50 km) + search criteria ( eg restaurent) ?

Output shall be Kml/csv .

There are plenty of other POI databases out there. Do you have a specific reason as to why you want to use Google? –  Geoist Aug 22 '12 at 7:35

I'm pretty sure what you're trying to do is against the terms of service unless you're simply relaying that information back to google maps for display purposes. Depending on the location you're focusing on there could be other POI which are arguably better. If you still insist on Google, you might look at the (deprecated) local search API: developers.google.com/maps/documentation/localsearch –  Geoist Aug 22 '12 at 11:59
