Google maps POI download

Is there any legal way to search and download google maps POI , based on user location and search radius (50 km) + search criteria ( eg restaurent) ? Output shall be Kml/csv .

Does a national(USA) interstate rest stop/rest area dataset exist?

And I don't care about format--worry about that later! I found some maps in Google maps, usually per state. I also have one map made my someone else, that no longer appears in the Google Maps search ...
