Just a thought, but could you try ticking the layer stack option to see if it produces a different result? According to docs (gdal.org/gdal_merge.html ) it should "Place each input file into a separate stacked band."

hmm, on OSX so not sure how it works on a non-unix environment. The -o filename.gml just stores the output. What do you get when you type curl --help
